Terms of Service

1.Scope

These terms apply to all offers and contracts between Sarah Hartel | sarahby ("sarahby") and clients for culinary events, dinners, food installations and related services. Deviating terms of the client apply only if confirmed in writing.

2.Offer and conclusion of contract

An inquiry through the website is not yet a binding order. After the initial conversation, the client receives an individual concept and offer. The contract is concluded when the client confirms the offer in text form (email is sufficient) and, where agreed, the deposit has been received.

3.Prices and payment

All prices are stated in the offer. Unless agreed otherwise, a deposit of 50 percent of the offer total is due upon confirmation; the remaining balance is due within 7 days after the event. Costs for specifically agreed third-party services (location, rentals, staff beyond the agreed team) are itemised in the offer.

4.Client cooperation

The client provides access to the venue at the agreed times and ensures the technical and legal prerequisites of the location (power, water, permissions of the venue owner). Guest numbers, dietary requirements and allergies must be communicated no later than 7 days before the event.

5.Changes and cancellation by the client

Up to 21 days before the event, cancellation is free of charge; the deposit is refunded minus costs already incurred (for example non-refundable orders). 20 to 8 days before the event: 50 percent of the agreed total. 7 days or less before the event: 80 percent of the agreed total. Reductions in guest numbers communicated less than 7 days before the event are charged as confirmed. Date changes are treated like a cancellation unless a new date can be agreed within 6 months and no third-party costs are lost.

6.Cancellation and changes by sarahby

If sarahby has to cancel for reasons within its control, all payments are refunded in full. If performance becomes impossible due to force majeure (including official orders, extreme weather, serious illness), both parties may withdraw; payments are refunded minus documented, unavoidable third-party costs. sarahby may replace individual team members and adjust menu details of equal quality where sourcing requires it; the character of the agreed concept remains unchanged.

7.Allergies and food safety

Menus are planned around dietary requirements communicated in advance (section 4). The client is responsible for the completeness of this information towards their guests. sarahby prepares food according to professional hygiene standards; liability for reactions to undisclosed allergies or intolerances is excluded to the extent legally permissible.

8.Photography and reference

sarahby may photograph the culinary work and the set tables for its portfolio and communication, unless the client objects in text form before the event. Guests are not photographed in an identifiable way without consent. Named client references (brand or person) are used only with prior approval.

9.Liability

sarahby is liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence, liability is limited to the breach of essential contractual duties and to the foreseeable damage typical for this type of contract. The client is responsible for the venue and items provided by the client or their guests.

10.Final provisions

German law applies. If the client is a merchant, the place of jurisdiction is the registered seat of sarahby. Should individual provisions be invalid, the remainder stays unaffected.
